In Wisconsin recently, a case was brought before court in which three men were charged with digging up a grave of a twenty year old female who had been killed the previous week. The men confessed they had dug up the grave in order to have sex with the corpse. However, the court dropped the sexual assault charges brought up against the men because, in the state of Wisconsin, necrophilia is not illegal. SourceSo what are everybody's thoughts on this? Should Necrophilia be illegal? Why or why not? Is necrophilia disrespectful to the family of the corpse and the corpse itself? Should the men have been charged with sexual assault? And how would you feel if the corpse was someone you knew?

I personally do think it is a distgusting act. However, I'm not sure that I could say it is immoral. As was pinted out earlier, they don't choose to have this urge. I'm just not sure there is a way to do it without being disrespectful.

Are you sure? In the source I posted, there is the line "Wisconsin has no law against necrophilia, an appeals court ruled Thursday." Also, though Dahmer did commit acts of Necrophilia, along with cannibalism, I don't think he was charged with either, especially since murder trumps both. (The only source I have on this is Wikipedia.)

i dont think that is true, about it not being illegal, because jeffery dahmer was charged with necrophillia.

I agree that if there are laws made against necrophilia that it'd be because of desecration, looting, invasion of property, etc., not because it's "stupid" or "gross." That's just how some people are.

Yuck.  I think this is justv gross but i also agree it is a serious issue. I maen who wuold even want to do somthing like that any way?  But at least this person attmitted to the crime. Oh and i hope this is not legal. And if it is YIKES!!!!!!!!

I can only imagine what it must feel like for the ones doing the violating. Confessions of a Necrophile - the true story of a man that could just not give up his love for dead bodies. I mean seriously though, with paraphilia, it chooses the person, the person does not choose the paraphilia. It must suck to be a person that is a necrophile and fully hate what they are attracted to.
I like these calm little moments before the storm.

You can always tell if a post has been edited by a mod because it will always show an edit tag at the end. The poster has 10 minutes after posting to edit their own posts. There was one post removed for a rules of play violation and it was not posted by SilverWerewolf.
It's nice to be important but it's more important to be nice.

I'm glad we can make laws against things that are sick and gross simply because they're sick and gross.....oh wait, that's not how anything works. Desecration of a grave, stealing/destruction of property, trespassing, vandalism, and/or sexual indeceny should cover most crimes of necrophilia.

That would depend on different individuals, I suppose. A prosecutor would use the former, while a defense lawyer would use the latter.

Rape is defined in a general matter as "sexual acts performed with out consent" this lack of consent could be seen to require the ability to give consent because you can't lack what you don't have. I know that we have a healthy respect for the dead but asking a body consent is kind of like asking a chair consent to sit in it. It's foolish, why? because the chair cannot give consent. So while necrophilia isn't rape (under this working definition) it is still very nasty and should be a crime in it's own right (the exception being if the deceased specifies that their body be donated to a necrophiliac group, kinda like donating your body to science only icky from the general perspective)

Why should it be illegal? Because that is sick..and gross! And very disrespectful to the dead!
