If you say yes then its not rape, unless you are underage and the other person is older, then it is statutory rape no matter what! But when someone forces you, against your will that is rape. Its so sad that it happens everywhere. That is one of those things that makes me very angry! But if you give in its not rape, its consensual. If you don't want it then say no, and if they proceed, thats rape. If that happens go straight to the authoritys. Do not let anyone scare you away from doing that! You deserve justice for whats happened to you!!

Also, if the person forcing the other was 18 or older and the one being forced was underage during the time when this occur then it is also constituted as rape, even if the youngest person gave in.

Legally, I don't know. But if you feel raped, then you probably were. Also, were you afraid? If you thought he would hurt you or someone else if you didn't give in, then it was rape, to me. If you did it so he wouldn't break up with you (if it was your BF) or something like that, he was a jerk to pressure you like that, but I don't see it as rape. Also, personal question: when you talk about "giving in," do you mean you stopped fighting and just kind of laid there, or you started liking it and actively participated? Even if you did, it could still be rape; forcing someone in any way is just plain wrong. Email me if you want to talk. God bless.

Sorry I meant to type "think" Well, Gem. Not always. The guy/girl could only get jail for 3 yrs. It's not always a long period of time. Some of them can get of with a few months and probation. -JM

"Giving in" is vague.
Rape is rape.
If someone is underage - no matter if they consent or not - that constitutes as rape, and that will put their partner in jail for a long time.

It would depend on whether there was a physical or psychological threat present. IE: he had a gun, or he told you he would hurt you or you family if you didnt give in, etc.
BTW, since you are under 18, if the guy was over 18 and at least 4 years older than you you can get him with statutory rape, regardless.

no, i dont think so...most cases of rape, the person does not give in.
